1. Agreement to these terms
These Terms and Conditions (“Terms”) apply when you visit or use fernpixels.com (the “Site”). By using the Site, you agree to these Terms and our Privacy Policy and Cookie Policy. If you do not agree, please do not use the Site.
“FernPixels”, “we”, “us” and “our” refer to the operator of the FernPixels editorial website. “You” means a visitor or user of the Site.
2. What FernPixels provides
FernPixels is an independent information and entertainment publication. We research, compare and review free-to-play online video games with particular attention to New Zealand players. The Site may provide editorial ratings, summaries, platform information, links and general guidance.
We do not publish or operate the featured games. We do not create or manage your account with a publisher, console platform or digital store. We are not an agent, partner or representative of a featured developer or publisher unless a specific page says otherwise.
3. Free-play and no-money statement
“Free”, “free-to-play” and “free to start” mean that a game's publisher provides a playable entry point without an upfront game purchase at the time we review it. A publisher may separately offer optional purchases, subscriptions, digital currency, cosmetics, battle passes, expansions or platform services. Those optional transactions occur with the publisher or platform, not FernPixels.
Availability, age ratings, features, prices and monetisation can change. Check the official store listing and seek permission from the payment account holder before making any optional purchase. Editorial scores never promise financial value or a chance to win anything of real-world value.
4. Who may use the Site
You may browse the Site if you can lawfully access online content in your location. If you are under 18, use the Site with the involvement of a parent or guardian. The games we discuss have different age classifications; our inclusion of a title is not a statement that it is suitable for every age.
Parents and guardians should review applicable New Zealand classification information, online communication features, in-game purchase controls and the publisher's terms before allowing a child to play.
5. Acceptable use
You must not:
- use the Site unlawfully, fraudulently or to harm another person;
- attempt to bypass security, introduce malware, overload the Site or interfere with its operation;
- scrape, crawl or copy the Site at a scale that materially affects service or ignores technical restrictions;
- impersonate FernPixels or misrepresent a connection with us;
- use Site content to promote gambling, scams, account trading or unlawful financial activity;
- infringe intellectual property, privacy or other legal rights; or
- send unsolicited advertising or abusive content to our contact addresses.
We may restrict access, preserve evidence or contact relevant providers or authorities where reasonably necessary to protect the Site or others.
6. Editorial reviews and scores
Fern Scores express our editorial assessment at the time of review. We consider gameplay, free value, performance, community and longevity, but reasonable players may disagree. Scores are not scientific measurements, professional advice or guarantees of quality, availability, safety, server performance or future support.
We aim to correct material factual errors. You can send a correction to hello@fernpixels.com. Any sponsored or affiliate content will be labelled clearly and kept separate from our scoring decision. Unless expressly stated, inclusion is not a paid endorsement.
7. Third-party games, stores and links
The Site links to websites and services controlled by game publishers, developers, console platforms and digital stores. Their terms, privacy policies, purchase rules, refund processes, moderation and technical requirements apply when you use them. We do not control or guarantee those services.
Before downloading, check system requirements, data usage, download size, account requirements, anti-cheat software, subscriptions and any optional spending. You are responsible for protecting your accounts and devices.
8. Intellectual property
FernPixels' original name, logo, site design, written reviews, rating system, layout and original artwork are protected by applicable intellectual property laws. You may view and share links to public Site pages for personal, non-commercial use. You may quote a short excerpt with clear attribution and a link, but you may not reproduce substantial content, remove notices, create a confusingly similar service or commercially exploit our materials without written permission.
Game names, logos, screenshots and key art are owned by their respective publishers and rights holders. They are shown for identification, commentary and review. All third-party rights remain with their owners, and no endorsement or affiliation is implied.
If you believe material on the Site infringes your rights, email legal@fernpixels.com with the work, location, your authority and the requested action.
9. Availability and disclaimers
We work to keep the Site useful and accurate, but information may become outdated and the Site may occasionally be unavailable. To the extent permitted by law, the Site is provided “as is” and “as available”, without a promise that it will be uninterrupted, error-free or suitable for a particular device or purpose.
Nothing in these Terms excludes, restricts or modifies a right or remedy that cannot lawfully be excluded, including any applicable rights under New Zealand consumer law. If you use the Site for business purposes, consumer guarantees that are lawfully capable of being contracted out of may not apply to the extent permitted by law.
10. Responsibility and liability
You remain responsible for deciding whether a game is appropriate for you, your household and your device. To the extent permitted by law, FernPixels is not responsible for loss caused by a third-party game or service, publisher decisions, account actions, optional purchases, malicious downloads from unofficial sources, player conduct or reliance on information after it has become outdated.
Where our liability cannot be excluded, it is limited only to the extent permitted by applicable law. Nothing here limits liability for fraud, wilful misconduct, or another liability that the law says cannot be limited.
11. Changes, governing law and contact
We may update the Site and these Terms. Updated Terms apply from the effective date shown at the top. If a change materially affects Site use, we will take reasonable steps to highlight it.
If a provision is held unenforceable, the remaining provisions continue. A delay in enforcing a right is not a waiver. These Terms are governed by New Zealand law, and New Zealand courts have non-exclusive jurisdiction, subject to any mandatory law that applies where you live.
